Terms of Service

These terms govern your use of SilentBid (the "Service"), operated for schools, clubs, sports teams, charities, and similar organizations ("organizers") to run online silent auctions, and for their guests ("bidders") to participate. By creating an auction or placing a bid, you agree to these terms.

What SilentBid is (and isn't)

SilentBid is a tool for listing items, tracking bids, and identifying auction winners. We are not a party to the transaction between an organizer and a winning bidder, and we do not process, collect, or hold any payment for auctioned items. Organizers are solely responsible for collecting payment from winning bidders and fulfilling items — however works for their event (e-transfer, cash, cheque, etc.).

Accounts

Organizers must provide accurate contact information and are responsible for keeping their password secure and for all activity under their account. You must be authorized to run a fundraiser on behalf of the organization you represent. Bidders don't need a password — a session tied to your contact info is used to identify you within an auction.

Organizer responsibilities

  • You're responsible for the accuracy of item listings, descriptions, and starting bids.
  • You're responsible for legally obtaining and having the right to auction any item you list.
  • You're responsible for collecting payment from winning bidders and delivering the items.
  • You may not list illegal items, or items that violate the rights of a third party.
  • You're responsible for complying with any laws or regulations that apply to charitable fundraising or raffles/auctions in your jurisdiction.

Bidder responsibilities

A bid is a genuine commitment to purchase the item at that amount if you win. Don't place a bid you're not prepared to honor. Winning bidders are responsible for completing payment directly with the organizer.

Pricing

Auctions with up to 10 items are free. Larger auctions require a one-time platform fee per event, based on auction size, as described on our pricing page. There are no recurring subscriptions — you pay once per auction. Fees are processed by Stripe and are generally non-refundable once an auction has been published, except where required by law.

Acceptable use

You may not use SilentBid to defraud anyone, launder money, list stolen or counterfeit goods, harass other users, or attempt to interfere with or abuse the platform (including scraping, automated bidding, or attempting to access accounts or auctions you don't have permission to access). We may suspend or remove any account or auction that violates these terms.

Disclaimers & limitation of liability

SilentBid is provided "as is," without warranties of any kind. We do our best to keep the platform available and accurate, but we don't guarantee uninterrupted service, and we're not responsible for disputes between organizers and bidders, the condition or delivery of auctioned items, or losses arising from use of the Service. To the fullest extent permitted by law, SilentBid's liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim arose.

Changes

We may update these terms from time to time. If we make material changes, we'll update the date at the top of this page. Continued use of SilentBid after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of Canada, without regard to conflict-of-law principles.
